3. شروط الخدمة

3.1 Acceptance of Terms

3.1 قبول الشروط

EN: By accessing or placing an order through swift-padel.myshopify.com ("the Site"), you agree to be bound by these Terms of Service, our Return and Refund Policy, Shipping Policy, and Privacy Policy, all of which form part of a single agreement between you ("the customer") and Swift Padel ("we," "us," "our"). If you do not agree, you must not use the Site or place an order.

AR: من خلال الدخول إلى موقع swift-padel.myshopify.com أو تقديم طلب من خلاله ("الموقع")، فإنك توافق على الالتزام بشروط الخدمة هذه، وسياسة الإرجاع والاسترداد، وسياسة الشحن، وسياسة الخصوصية الخاصة بنا، والتي تشكل جميعها اتفاقية واحدة بينك ("العميل") وبين سويفت بادل ("نحن"). في حال عدم موافقتك، يجب عدم استخدام الموقع أو تقديم أي طلب.

3.2 Products and Pricing

EN: All products listed on the Site (padel rackets, bags, and accessories) are subject to availability. Prices are listed in Egyptian Pounds (LE/EGP) and may be changed at any time without prior notice, provided that any change will not affect an order already confirmed and paid for. Swift Padel makes reasonable efforts to ensure product descriptions, images, and specifications are accurate, but does not guarantee that all details (such as exact weight, balance, or color reproduction on different screens) are free of minor discrepancies.

AR: جميع المنتجات المعروضة على الموقع (مضارب البادل، الحقائب، والإكسسوارات) تخضع للتوفر. الأسعار معروضة بالجنيه المصري وقد يتم تغييرها في أي وقت دون إشعار مسبق، على ألا يؤثر أي تغيير على طلب تم تأكيده والدفع مقابله بالفعل. تبذل سويفت بادل جهودًا معقولة لضمان دقة أوصاف المنتجات وصورها ومواصفاتها، ولكنها لا تضمن خلو جميع التفاصيل (مثل الوزن الدقيق أو التوازن أو دقة الألوان على الشاشات المختلفة) من فروقات بسيطة.

3.3 Orders and Payment

3.3 الطلبات والدفع

EN: Placing an order constitutes an offer to purchase, which Swift Padel may accept or decline at its discretion (for example, in cases of suspected fraud, pricing errors, or stock unavailability). Payment must be completed in full through one of the Site's accepted payment methods before an order is processed. Swift Padel reserves the right to cancel any order at any time prior to dispatch if fraud, error, or non-payment is suspected, with a full refund issued in such cases.

AR: يُعتبر تقديم الطلب عرضًا للشراء، ويجوز لسويفت بادل قبوله أو رفضه وفقًا لتقديرها (على سبيل المثال، في حال الاشتباه في احتيال، أو خطأ في السعر، أو عدم توفر المخزون). يجب إتمام الدفع بالكامل من خلال إحدى وسائل الدفع المعتمدة في الموقع قبل معالجة الطلب. تحتفظ سويفت بادل بالحق في إلغاء أي طلب في أي وقت قبل الشحن في حال الاشتباه في احتيال أو خطأ أو عدم دفع، مع رد كامل للمبلغ في هذه الحالات.

3.4 Account Registration

3.4 إنشاء الحساب

EN: If you create a customer account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. By creating an account and/or placing an order, you confirm that all information you provide (name, address, phone number, and payment details) is accurate and that you agree to these Terms of Service and all linked policies. Swift Padel may suspend or terminate any account suspected of fraudulent activity or repeated abuse of our policies (including repeated unfounded defect claims or repeated last-minute cancellations).

AR: في حال إنشائك حسابًا كعميل على الموقع، فإنك تتحمل مسؤولية الحفاظ على سرية بيانات دخولك وجميع الأنشطة التي تتم من خلال حسابك. بإنشاء حساب و/أو تقديم طلب، فإنك تؤكد أن جميع المعلومات التي تقدمها (الاسم، العنوان، رقم الهاتف، وتفاصيل الدفع) دقيقة، وأنك توافق على شروط الخدمة هذه وجميع السياسات المرتبطة بها. يجوز لسويفت بادل تعليق أو إنهاء أي حساب يُشتبه في قيامه بنشاط احتيالي أو إساءة استخدام متكررة لسياساتنا (بما في ذلك تكرار مطالبات العيوب غير المبررة أو الإلغاءات المتكررة في آخر لحظة).

3.5 Intellectual Property

3.5 الملكية الفكرية

EN: All content on the Site — including the Swift Padel name, logo, product photography, and written descriptions — is the property of Swift Padel or its licensors and may not be copied, reproduced, or used commercially without prior written consent. Brand names, logos, and trademarks of third-party manufacturers (SIUX, NOX, Adidas, Head, Bullpadel, Babolat, and others) referenced on the Site remain the property of their respective owners and are used solely to identify and describe genuine products offered for sale.

AR: جميع المحتويات الموجودة على الموقع — بما في ذلك اسم وشعار سويفت بادل، وصور المنتجات، والأوصاف المكتوبة — هي ملك لسويفت بادل أو الجهات المرخصة لها، ولا يجوز نسخها أو إعادة إنتاجها أو استخدامها تجاريًا دون موافقة خطية مسبقة. أسماء العلامات التجارية والشعارات الخاصة بالشركات المصنعة الأخرى (SIUX، NOX، Adidas، Head، Bullpadel، Babolat، وغيرها) المذكورة على الموقع تبقى ملكًا لأصحابها، ويتم استخدامها فقط لتحديد ووصف المنتجات الأصلية المعروضة للبيع.

3.6 Limitation of Liability

3.6 حدود المسؤولية

EN: To the maximum extent permitted by applicable law, Swift Padel's total liability arising from any order shall not exceed the amount paid by the customer for that order. Swift Padel shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of enjoyment, missed matches or tournaments, or any damages arising from third-party courier services as described in our Shipping Policy.

AR: إلى أقصى حد يسمح به القانون المعمول به، لا تتجاوز مسؤولية سويفت بادل الكلية الناشئة عن أي طلب المبلغ الذي دفعه العميل مقابل ذلك الطلب. لا تتحمل سويفت بادل أي مسؤولية عن أضرار غير مباشرة أو عرضية أو تبعية، بما في ذلك على سبيل المثال لا الحصر فقدان المتعة، أو تفويت مباريات أو بطولات، أو أي أضرار ناتجة عن خدمات شركات التوصيل من طرف ثالث كما هو موضح في سياسة الشحن.

3.7 Governing Law and Disputes

3.7 القانون الحاكم وتسوية النزاعات

EN: These Terms of Service are governed by the laws of the Arab Republic of Egypt. Any dispute arising from an order or from use of the Site shall first be addressed through direct communication with Swift Padel via the contact details in Section 5 (Contact Information). If a resolution cannot be reached, the dispute shall be subject to the exclusive jurisdiction of the competent courts of Cairo, Egypt.

AR: تخضع شروط الخدمة هذه لقوانين جمهورية مصر العربية. يتم أولاً معالجة أي نزاع ينشأ عن طلب أو عن استخدام الموقع من خلال التواصل المباشر مع سويفت بادل عبر بيانات التواصل الموضحة في البند 5 (معلومات التواصل). في حال تعذر الوصول إلى حل، يخضع النزاع للاختصاص القضائي الحصري للمحاكم المختصة في القاهرة، مصر.

3.8 Changes to These Terms

3.8 التعديلات على هذه الشروط

EN: Swift Padel may update these Terms of Service at any time without prior notice. The version in effect at the time an order is placed governs that order. Continued use of the Site after any change constitutes acceptance of the revised Terms.

AR: يجوز لسويفت بادل تحديث شروط الخدمة هذه في أي وقت دون إشعار مسبق. النسخة السارية وقت تقديم الطلب هي التي تحكم ذلك الطلب. يُعتبر استمرار استخدام الموقع بعد أي تعديل بمثابة موافقة على الشروط المُحدَّثة.
